REGISTRY OF CIVIL MARRIAGES
BRUNEI DARUSSALAM

IMPORTANT INFORMATION FOR COUPLES WISHING TO BE MARRIED AT THE REGISTRY UNDER S.23 OF THE MARRIAGE ACT (CAP 76)

Note:     A Notice of Marriage must be filed at least 14 days before a marriage may be solemnized.

1. REQUIREMENTS FOR FILING A NOTICE OF MARRIAGE

1.1  An Applicant must:-               

a)   be more than 18 years of age.

b)   reside in Brunei Darussalam for a minimum period of 14 days (this condition may be satisfied by one of the couple),

c)    not be married to any other third party

d)    not be related to the other party to the marriage,

e)    be of sound mind.

f)     not be of Muslim faith.

1.2  Before filing the Notice, the applicant couple must attend personally to swear a Statutory Declaration with respect to the conditions specified in note 1 above. These Declaration forms will be supplied to the couple at the time of filing the Notice.

1.3  To make the Declaration in 1.2 and to the file the Notice of Marriage, the applicant couple must bring with them the following documents:-

a)       Brunei Identity Card,     or,

b)       If the applicant is a foreigner, his passport):

c)       Two $10.00 postal stamps;

d)       Documents to prove the marital status of the applicant:-

                  i.    Where Divorced:

                Original & Photocopy of Decree Absolute;

                  ii.   Where Widowed:

1. Original and Photocopy of Death Certificate of deceased spouse;

2. Original & photocopy of Certified of previous marriage.

                  iii.  Where A Philippines National:

Certification of eligibility to contract marriage issued by the Philippines Embassy.

              iv.      Where A Foreigner (Non-Philippines National) who has never been married previously:-

           An official certificate which declares the single-hood of the applicant. This could be:

Either      1.  A certified of No Impediment to Marry issued by the Marriage Registry of the applicant’s Country of Origin.

OR          2.  Affidavit or Statutory Declaration sworn by the applicant’s parents.

1.4   Where a foreigner intends to marry a Brunei Citizen or Brunei Permanent Resident, the applicant couple must also bring (in addition to any relevant documents stated in note 1.3(c), when filing a Notice of Marriage):

A letter granting permission from the Department of Immigration (Permission must be sought prior to the filing of a Notice of   Marriage)

 

2.  HOURS FOR FILING NOTICE OF MARRIAGE

2.1                   Mondays to Thursdays –

                        8.00 a.m. to 11.00 a.m.

          2.00 p.m. to 3.15 p.m.

2.2  Notice of Marriages must be filed at the District where the applicants ordinarily reside.

¨ the address for all districts (except Kuala Belait District) is : “Marriage Registry, 2nd floor, Supreme Court, Jalan Tutong, Bandar Seri Begawan”.

¨ For the Kuala Belait District: “Magistrate’s Court, Kuala Belait”.

 

3. FEES AND BOOKING ARRANGEMENTS.

3.1  Fee for marriages at the registry are:

 Filing a Notice of  Marriage - $100.00

            Solemnization of Marriage - $100.00

3.2  If it becomes necessary to change the day or time fixed for a marriage, new booking arrangements will be negotiated.

3.3  Marriages are solemnized on Saturday mornings only.

3.4  The date of solemnization will be fixed on a Saturday after at least 14 days from the date of filing of the Notice of Marriage.

3.5  Upon filing of a Notice of Marriage, a Guide on Solemnization will be issued to the applicants.

Applicants are strongly advised to read this guide carefully.
